We arrived at the neighborhood in Antwerp where our accommodation, Adagio Aprthotel, was located. The presence of immigrants was the one of the first things that caught my attention. They are everywhere. Enroute to the shops past the train station after dropping off our bags, Amiel and I passed a synagogue, and at McDonald’s (yup, my first meal in Belgium was french fries!), seated at the next table were two Filipinos. Overhearing their chatter, I surmised that they have been living (...) in Antwerp for some time. While intently exploring the surrounding streets, it became obvious that there is a profusion of migrant communities in Antwerp offering a multifaceted panorama of cultural diversity. This iss underscored by the conspicuous presence of Orthodox Jews, Arabs, Africans, and Chinese, the latter ensconced in their own Chinatown. Our neighborhood afforded immersion within a milieu teeming with migrant-owned enterprises, from butcher shops and corner stores to quaint cafés and eateries, predominantly overseen by Middle Easterners and Jews. Our first communal meal was, in fact, at an Arabic restaurant just across our accommodations. (shrink)

The editor's introduction discusses Clarence I. Lewis's conceptual pragmatism when compared with post-empiricist epistemology and argues that several Cartesian assumptions play a major role in the work, not unlike those of Logical Positivism. The suggestion is made that the Cartesian legacy still hidden in Logical Positivism turns out to be a rather heavy ballast for Lewis’s project of restructuring epistemology in a pragmatist key. More in detail, the sore point is the nature of inter-subjectivity. For Lewis, no less than (...) for the Logical Positivists at the time of the Protocols Controversy and Husserl in the Cartesian Meditations, this is a problem without a solution. The reason is that all these philosophers are apparently unable to realize that the existence of a plurality of knowing subjects cannot be treated at once both as a speculative problem and a methodological one. Lewis, thanks to his pragmatist approach both comes closer to the right answer and offers an even more naïve unsatisfactory solution to the pseudo-problem under discussion. The fact that he has clear in mind that inter-subjectivity means not only a plurality of linguistic utterances but also a co-existence of different kinds of practical behaviour. Eventually, the very idea of mind, the key-idea in the book, suffers from the above mentioned tension. In fact, if inter-subjective communication and action is considered at a methodological level, the very idea of mind would not need an analysis, and no kind of ‘reflexive’ analysis. Methodology might be limited to a ‘naïve’ level where the existence of the world and a plurality of subjects be taken as a bedrock of uncritically accepted evidence. Philosophical reflection on ultimate evidence, instead, would take a different approach, maybe the one Wittgenstein was putting into practice in the same years when Mind and the world order was written, namely it would be bound to question the very meaning of the idea of ‘mind’ as an undue fiction – the same carried out by Descartes – when he assumed the Cogito to be at once a body of self-evident truths and a thing or substance, the familiar Platonic idea of psyche or soul. Innovative practice occurs when a clinician provides something new, untested, or nonstandard to a patient in the course of clinical care, rather than as part of a research study. Commentators have noted that patients engaged in innovative practice are at significant risk of suffering harm, exploitation, or autonomy violations. By creating a pathway for harmful or nonbeneficial interventions to spread within medical practice without being subjected to rigorous scientific evaluation, innovative practice poses similar risks to the wider community of patients (...) and society as a whole. Given these concerns, how should we control and oversee innovative practice, and in particular, how should we coordinate innovative practice and clinical research? In this article, I argue that an ethical approach to overseeing innovative practice must encourage the early transition to rigorous clinical research without delaying or deferring the development of beneficial innovations or violating the autonomy rights of clinicians and their patients. Many contemporary ethical debates turn on claims about the nature and extent of our alleged procreative moral rights: moral rights to procreate or not to procreate as we choose. In this article, I argue that there are no procreative moral rights, in that generally we do not have a distinctive moral right to procreate or not to procreate as we choose. However, interference with our procreative choices usually violates our nonprocreative moral rights, such as our moral rights to bodily autonomy (...) or to privacy. My argument presents hypothetical cases in which a state interferes with a person's procreative choices in order to promote aggregate social welfare, but this interference does not violate any of the person's nonprocreative moral rights. These cases not only undermine frequently made claims that widely recognized nonprocreative moral rights entail procreative moral rights, they also challenge the intuitively plausible claim that interference with our procreative choices as such violates our moral rights. What at first appear to be substantive moral rights are in fact a kind of illusion created by the frequent overlap of other rights, but lacking in substance beyond that overlap. While this argument against the existence of procreative moral rights has substantive implications for ongoing debates in reproductive ethics, I ultimately suggest that it is consistent with a progressive approach to reproductive justice. Although researchers generally take great care to ensure that human subjects do not suffer very serious harms from their involvement in research, the situation is different for nonhuman animal subjects. Significant progress has been made in reducing unnecessary animal suffering in research, yet researchers still inflict severe pain and distress on tens of thousands of animals every year for scientific purposes. Some bioethicists, scientists, and animal welfare advocates argue for placing an upper limit on the suffering researchers may impose on (...) animal subjects, with rare exceptions for research that promises critical social benefits. In this article, I argue against such an upper limit on harm on the grounds that researchers often can compensate animal subjects for their suffering, even severe and long-lasting suffering. If animal subjects receive adequate compensation for the harms they suffer, then there is no general limit on how much suffering researchers may impose on them for scientific purposes. (shrink)

Si se consideran seriamente, tales concepciones se pronuncian sobre cuestiones ontológicas y metafísicas. En la medida en que sean dignas de crédito, sus pronunciamientos ontológicos y metafísicos resultan relevantes para múltiples facetas de la práctica médica, como (...) el diagnóstico, el tratamiento, la investigación, la prevención y el control de enfermedades, pero también para el cuidado y la promoción de la salud. En este capítulo se exploran cuestiones metafísicas generales en torno a la concepción de la práctica médica más influyente en el mundo actual: la biomedicina. Sostengo que, a pesar de que el asombroso éxito de las ciencias biomédicas nos ofrece razones para creer en la verdad (aproximada) de las representaciones que toman como base, esa confianza no debería estar asociada selectivamente a pronunciamientos específicos sobre qué cosas existen y cómo se conectan; además, nuestro grado de convicción en los resultados de la investigación biomédica debería estar calibrado al tomar en cuenta vulnerabilidades ampliamente reconocidas de este ámbito de indagación. Comienzo caracterizando la biomedicina como la aplicación de los resultados de la investigación científica a la práctica médica. Examino razones generales para creer en la verdad de las representaciones con las que opera este modelo de la práctica médica, recapitulando de manera panorámica el debate en torno al realismo científico. Luego consideraro aspectos relevantes para este debate que conciernen específicamente a las ciencias biomédicas, así como algunas consecuencias para el ámbito de la biomedicina que se desprenden de adoptar varias posiciones en torno al realismo científico. Concluyo ofreciendo una defensa del realismo carte blanche como la posición más sensata que puede adoptarse en este ámbito. (shrink)

One of the Belmont Report’s most important contributions was the clear and serviceable distinction it drew between standard medical practice and biomedical research. A less well-known achievement of the Report was its conceptualization of innovative practice, a type of medical practice that is often mistaken for research because it is new, untested, or experimental. Although the discussion of innovative practice in Belmont is brief and somewhat cryptic, this does not reflect the significant progress its authors made in understanding innovative practice (...) and the distinctive ethical issues it raises. This article explores the history and broader context of Belmont’s conception of innovative practice, its strengths and weaknesses, and its contemporary relevance for scholars working in bioethics and health policy. While this conception of innovative practice deserves our attention, it is inherently limited in some important ways. (shrink)

Several philosophers have recently argued that policies aimed at reducing human fertility are a practical and morally justifiable way to mitigate the risk of dangerous climate change. There is a powerful objection to such “population engineering” proposals: even if drastic fertility reductions are needed to prevent dangerous climate change, implementing those reductions would wreak havoc on the global economy, which would seriously undermine international antipoverty efforts. In this article, we articulate this economic objection to population engineering and show how it (...) fails. We argue, first, that the economic objection paints an inaccurate picture of the complicated relationship between demographic change and economic growth, and second, that any untoward economic effects of fertility reduction can be mitigated with additional policies. Specifically, we argue that supplementing fertility reduction with policies that facilitate the emigration of younger people from developing nations to developed nations could allow for both global reductions in GHG emissions and continued economic stability. Further, we show that moral arguments against such unprecedented increases in immigration are unsuccessful. We conclude that population engineering is a practical and morally justifiable tool for addressing the twin evils of climate change and global poverty. (shrink)

The Procreation Asymmetry holds that we have strong moral reasons not to create miserable people for their own sakes, but no moral reasons to create happy people for their own sakes. To defend this conjunction against an argument that it leads to inconsistency, I show how recognizing ‘creation’ as a temporally extended process allows us to revise the conjuncts in a way that preserves their intuitive force. This defense of the Procreation Asymmetry is preferable to others because it does not (...) require us to take on controversial metaphysical or metaethical commitments – in other words, it has the theoretical virtue of portability. In what ways and how far does virtue shield someone against suffering evils? In other words, how do non-moral evils affect the lives of virtuous people and to what extent can someone endure evils while staying happy? The central purpose of this chapter is to answer these questions by exploring what Aristotle has to say about the effects of evils in human well-being in general and his treatment of extreme misfortunes.

Reactivity, or the phenomenon by which subjects tend to modify their behavior in virtue of their being studied upon, is often cited as one of the most important difficulties involved in social scientific experiments, and yet, there is to date a persistent conceptual muddle when dealing with the many dimensions of reactivity. This paper offers a conceptual framework for reactivity that draws on an interventionist approach to causality. The framework allows us to offer an unambiguous definition of reactivity and distinguishes (...) it from placebo effects. Further, it allows us to distinguish between benign and malignant forms of the phenomenon, depending on whether reactivity constitutes a danger to the validity of the causal inferences drawn from experimental data. A stunning phenomenon has dramatically changed the way in which we in the West regard the public sphere in particular, and democracy in general in the twenty-first century: the re-emergence of religion.

This paper seeks to defend physicalism from the zombie arguments proposed by David Chalmers and Saul Kripke. If philosophical zombies are conceivable and thereby metaphysically possible then the physicalis-tic stance falls. However this paper contends that the zombie argument is entirely reliant on the concept of qualia and its properties of ineffability, intrinsiness, privacy, directness, and immediate access to consciousness. Drawing on Daniel Dennet's arguments to "Quine Qualia", this paper ultimately concludes that a stalemate is reached between both positive and (...) negative arguments for the existence of qualia and thus the most parsimonious solution would be to reject qualia from one's ontology: dissolving the central tenet of the zombie argument. They say that argumentative writing skills are best learned through writing argumentative essays. I say that while this is excellent practice for argumentative writing, an important exercise to practice structuring such essays and build critical thinking skills simultaneously is what I call the four-sentence paper. The exercise has the template They say..., I say..., one might object..., I reply... One might object that the assignment oversimplifies argumentative writing, stifles creativity, promotes an adversarial attitude, or that students can’t consider objections well (...) anyway. I reply that a simplified form of argumentative writing is fine for beginners, especially since the template is ubiquitous in philosophy; that any assignment template has room for creativity; that considering objections is consistent with good manners; and that despite some pitfalls of trying to defend a thesis and consider objections, students are capable of considering objections well with proper instruction and practice. Nueva, porque no han terminado en el siglo XX las discusiones sobre dicha problemática, ni las aplicaciones posibles que se derivan de ella. Se trata del principio de identidad. El presente trabajo partirá de la definición del principio de identidad (...) según Aristóteles. Se matizarán algunos aspectos de tal principio según otros autores que han perseguido sobre todo fines didácticos al presentarlo, ya sea para el desarrollo de la teología como para el de la epistemología o la metafísica. Finalmente, se expondrá —de una manera bastante elemental— la utilización y las conclusiones que algunos autores contemporáneos han efectuado con relación a la identidad. The work presented has the following approach: starting from the Pope's reflection on the planet and ecological problems, it is intended to show the philosophical influences that underlie Francisco's exposition. These influences make it possible to describe a philosophical profile present in the encyclical Laudato si’. In addition, since philosophy claims to know, it is not exhausted only in knowledge, but tries to know in order to act; therefore, the presence of an ethical proposal follows; and since all ethics leads (...) to action, it follows that action cannot be without some indicators, without an axiology on which human action on the planet revolves. The result is that Francisco offers an ethic of otherness that feels the other as an authentic neighbor, even those who are in the future. It is an ethic of common benefit and caring for the other whose fundamental axis is the person and for this reason he reflects the phenomenon of human life within life on Earth, with which its philosophical approach seems personalist, from a point of Christian view. Our philosophical understanding of mental illness is being shaped by neuroscience. However, it has the paradoxical effect of igniting two radically opposed groups of philosophical views. On one side, skepticism and denialism assume that, lacking clear biological mechanisms and etiologies for most mental illnesses, we should infer they are constructions best explained by means of social factors. This is strongly associated with medical nihilism: it considers psychiatry more harmful than benign. On the other side of the divide, naturalism and reductionism (...) are on the look for failures in the biological functioning of the organism whenever a genuine mental illness occurs. Psychiatry as currently practiced, accordingly, exhibits the gaps of an ongoing research programme; a yet to be completed neuroscience would link mental illnesses with identifiable biological mechanisms. Both sides of this divide claim to be fostered by scientific discoveries and advances in neuroscience, when taken at face value. Against this background, we argue instead for a modest view. To that end, we draw attention to some nuances in the scientific realism debate. While contending that neuroscientific theories and models aim to provide true representations of their target systems, and can justifiably claim to have attained some, we argue that our confidence should not be placed beforehand in specific features of these scientific representations. Hence, it would be unwarranted to extract morals for psychiatry from posits (or their absence) in neuroscientific explanations of mental illnesses. To illustrate our position, we examine some recent discoveries in neuroscience concerning bipolar disorder. We conclude by linking our topic to a broader issue in the philosophy of medicine: insofar as psychiatry is a biomedical specialty, its classifications of health and disease are guided by pragmatic concerns, as well as by scientific discoveries. Clinical researchers should help respect the autonomy and promote the well-being of prospective study participants by helping them make voluntary, informed decisions about enrollment. However, participants often exhibit poor understanding of important information about clinical research. Bioethicists have given special attention to “misconceptions” about clinical research that can compromise participants’ decision-making, most notably the “therapeutic misconception.” These misconceptions typically involve false beliefs about a study’s purpose, or risks or potential benefits for participants. In this article, we describe a misconception involving (...) false beliefs about a study’s potential benefits for non-participants, or its expected social value. This social value misconception can compromise altruistically motivated participants’ decision-making, potentially threatening their autonomy and well-being. We show how the social value misconception raises ethical concerns for inherently low-value research, hyped research, and even ordinary research, and advocate for empirical and normative work to help understand and counteract this misconception’s potential negative impacts on participants. Innovative practice involves medical interventions that deviate from standard practice in significant ways. For many patients, innovative practice offers the best chance of successful treatment. Because little is known about most innovative treatments, clinicians who engage in innovative practice might consider including extra procedures, such as scans or blood draws, to gather information about the innovation. Such information-gathering interventions can yield valuable information for modifying the innovation to benefit future patients and for designing scientific studies of the innovation. However, existing (...) guidelines do not say when or whether it is appropriate to add potentially risky information-gathering interventions for these purposes. As a result, clinicians may assume that information-gathering interventions are ethically inappropriate and should not be used in innovative practice. This assumption can lead to seriously negative consequences, such as increasing the likelihood that harmful or ineffective innovations will be adopted and creating new barriers to the development of genuinely beneficial treatments. We argue that health care institutions need to promote the responsible use of information-gathering interventions as an adjunct to innovative practice, and that these interventions are not clinical research and should not be subject to research oversight. The specific role of empeiria in Aristotle’s ethics has received much less attention than its role in his epistemology, despite the fact that Aristotle explicitly stresses the importance of empeiria as a requirement for the receptivity to ethical arguments and as a source for the formation of phronêsis.1 Thus, while empeiria is an integral part of all explanations that scholars give of the Aristotelian account of the acquisition of technê and epistêmê, it is usually not prominent in explanations of the (...) acquisition of phronêsis.2 The abundant mentions of empeiria in Aristotle’s ethical treatises are often eclipsed in the secondary literature... In a world in which emotions and feelings occupy a dominant place in daily human life and especially in decision-making circumstances, it is important for us to ask ourselves whether it is possible to talk about “new” ethics or “renewed ethics.” Actually, we do not face a re-creation of principles and values, but rather we face a need for deepening our understanding of human anthropology. Thinkers such as Dietrich von Hildebrand have proposed that affectivity can shed light on ethics comprehension. (...) By means of a study of some of the works of this contemporary philosopher, we state that ethics is the result of a harmony between a clear objective comprehension of reality and a straight comprehension of that reality within the sphere of an educated, formed and well-known affectivity of the human person, which would lead us beyond the common place understanding of ethics as something rigid and full of rules and restrictions. -/- En un mundo en el que las emociones y los sentimientos ocupan un lugar preponderante en la vida cotidiana de las personas y especialmente en las decisiones que toman, cabe preguntarnos si podemos hablar de una nueva ética o de una ética renovada. En realidad no nos enfrentamos a una recreación de nuevos principios y valores, sino a una necesidad de ahondar en la antropología de la persona humana. En esta profundización se ha revalorado el importante papel que juega la afectividad en la vida humana. Pensadores como Dietrich von Hildebrand han propuesto que la afectividad puede dar luces en la comprensión de la ética. A partir de un estudio de algunas de las obras de este filósofo contemporáneo proponemos que la ética vendría siendo el resultado de una armonía entre la clara comprensión objetiva de la realidad y una recta comprensión de dicha realidad dentro de una esfera afectiva educada, formada, y ante todo conocida por la propia persona, lo cual nos conduce más allá de una ética entendida muchas veces como algo rígido lleno de normas y restricciones. Are we ever morally permitted to do what is morally wrong? It seems intuitive that we are, but evidence for dissociations among judgment of permissibility and wrongness are relatively scarce. Across 4 experiments (N = 1,438), we show that people judge that some behaviors can be morally wrong and permissible. The dissociations arise because these judgments track different morally relevant aspects of everyday moral encounters. Judgments of individual rights predicted permissibility but not wrongness, while character assessment predicted wrongness but not (...) permissibility. These findings suggest a picture in which moral evaluation is granular enough to express reasoning about different types of normative considerations, notably the possibility that people can exercise their rights in morally problematic ways. Una de las bifurcaciones en el debate contemporáneo sobre la legitimidad de la democracia explora si ésta ofrece ventajas distintivamente epistémicas frente a otras alternativas políticas. Quienes defienden la tesis de la democracia epistémica afirman que la democracia es instrumentalmente superior o equiparable a otras formas de organización política en lo que concierne a la obtención de varios bienes epistémicos. En este ensayo presento dos (grupos de) argumentos a favor de la democracia epistémica, que se inspiran en resultados formales: el (...) teorema del jurado de Condorcet [TJC] y el teorema ‘diversidad supera habilidad’ [DSH]. Pese a su gran atractivo, sostengo que estos argumentos son incapaces de respaldar dicha tesis: no brindan razones para considerar que la democracia es epistémicamente superior (o equiparable) a algunas alternativas políticas no democráticas. En su lugar, sugiero que, sin requerir un cambio radical en nuestras formas de organización política, la epistemología democrática –el estudio de las ‘circunstancias epistémicas de la democracia’– puede ofrecer valiosas lecciones de sobre cómo optimizar, en nuestra situación, instituciones y procedimientos de toma de decisiones. Para ello, primero distingo entre varias maneras de evaluar procedimientos de toma de decisión colectiva. Argumento que, al considerarlos como formas de organización política, un factor importante en la evaluación de tales procedimientos involucra asuntos fácticos sobre los cuales puede aspirarse a obtener o promover algunos bienes epistémicos. En este contexto, presento algunos de los argumentos más importantes a favor de la democracia epistémica. A continuación, reúno algunas de las objeciones sobre la aplicabilidad de dichos argumentos y ofrezco razones independientes para dudar de que ofrezcan apoyo a la tesis de la democracia epistémica. Finalmente, defiendo que la epistemología democrática puede desempeñar un papel significativo en la legitimación de formas de organización colectiva que podrían denominarse ‘democráticas’. (shrink)

The case (Dawson et al. 2024) describes an Institutional Review Board (IRB) chair who seeks consultation about waiving the requirement that investigators obtain prospective, informed consent for collection of microbiome samples by swabbing the perianal region of severely burned patients shortly after their admission to an intensive care unit (ICU). We argue that it is ethically permissible to waive informed consent requirements for the perianal swab and that the IRB should approve a waiver as permitted by regulations.

The case describes researchers who are seeking ethics guidance on communicating with participants in a phase-1 COVD-19 vaccine trial about FDA-authorized COVID-19 vaccines (Wilfond, Duenas, and Johnson 2023). The researchers want help choosing among three options they have identified for encouraging participants to obtain one of the authorized vaccines. We argue that research ethics consultants should consider going beyond this question to address another ethics concern the researchers might have overlooked.

The economic crisis in Europe exposes the European Union’s political fragility. How a polity made of very different states can live up to the motto “Europe united in diversity” is difficult to envisage in practice. In this paper I attempt an “exegesis”—a critical explanation or interpretation of a series of published pieces (“the Series”) which explores, first, if European unity is desirable at all. Second, it presents a new methodology—analogical hermeneutics—used throughout the Series to approach the problem of unity. Third, (...) it conceptualises the source of unity as political identity. Fourth, it advances that the vehicle to share such identity is an analogical language: the political culture of human rights. Fifth, it submits the conditions under which such political culture could ground political identity through an open public sphere. Finally, it presents a way in which solidarity can grow as the increasingly diverse citizens of the European Union interact with each other. Even though the economic crisis can be solved by means of sound economic strategy (which is not the main object of my work), any successful economic strategy requires—as a precondition—a certain degree of political unity (the central concern of my research). Great theologians, philosophers, anthropologists and sociologists and other specialists have written extensively on the subject. The philosophical contribution centered on the human person has been significant throughout history. In the last century, Romano Guardini, who received the Erasmus Prize for Best European Humanist and called "Master of Life" offers a view of reality man-centered, through a thin, deep and coherent approach on the individual. His work has (...) been labeled by some philosophers within the personalist current, and although his contributions were many, we want to highlight the elements of the meeting, the language and the self-acceptance. In this paper we propose how this approach to the human person can become an intinerary embodied in reality, that can help today to seek clarification and start delving into own personal knowledge enlightened by faith. -/- La persona humana ha sido analizada desde varios puntos de vista a lo largo de la historia. Grandes teólogos, filósofos, antropólogos y sociólogos entre otros especialistas han escrito profusamente acerca del tema. El aporte de una filosofía centrada en la persona humana ha sido significativo a lo largo de la historia. En el último siglo, Romano Guardini, quien recibió el Premio Erasmo al Mejor Humanista Europeo y llamado “Maestro de Vida”, propone una visión de la realidad centrada en el hombre, a través de una aproximación fina, profunda y coherente sobre la persona humana. Su trabajo ha sido catalogado por algunos filósofos dentro de la corriente personalista, y si bien sus aportes fueron muchos queremos resaltar los elementos del encuentro, el lenguaje y la aceptación de sí mismo. En este trabajo proponemos cómo dicha aproximación a la persona humana se puede convertir en un itinerario encarnado en la realidad que puede ayudar hoy en día a quienes buscan esclarecer y comenzar a ahondar en el propio conocimiento personal iluminados por la fe. Naturalism, construed as the idea that philosophy should be continuous with science, is a highly influential view. Its consequences for epistemology, however, are rather odd. Many believe that naturalized epistemology allows eschewing traditional skeptical challenges. This is often seen as an advantage; but it also calls into question its claim of belonging to the philosophical inquiry into knowledge. This paper argues that skeptical challenges can be stated to defy epistemic optimism within naturalized epistemology, and that there are distinctively naturalistic forms (...) of skepticism. To that end, it outlines some assumptions underlying many attempts to naturalize epistemology. It contrasts these approaches to traditional epistemology and identifies the reasons offered by naturalistic epistemologists to dismiss traditional skeptical challenges. Next, it argues that the problem of skepticism can be sensibly stated within a naturalistic setting. Finally, it contends that there are distinctively naturalistic strategies to argue for skepticism and diagnoses the prospects of naturalism vis-à-vis these kinds of skeptical challenges. (shrink)

El libro de María González Navarro se presenta a sí mismo como una “nueva hermenéutica” (23). La novedad involucra dos aspectos: uno que llamaremos metateórico y otro hermenéutico en propiedad. Hablando metateóricamente, el libro presenta una hermenéutica gadameriana vigorizada y robustecida por las teorías pragma-dialécticas de la argumentación. Desde el punto de vista hermenéutico propiamente dicho, la novedad reposa en que se considera que la interpretación correcta está indesligablemente vinculada a la argumentación abductiva.

This Ideas and Opinions article revisits an argument from Judith Jarvis Thomson in her essay “A Defense of Abortion” that abortion can be an ethical choice even if we assume that fetuses have full moral personhood and moral rights. The authors examine the implications of laws that require a pregnant person to care for another with their body and what other impositions states may also require of citizens to care for others.

In this paper I examine some of the positive epistemic and moral dimensions of anger in Plato’s dialogues. My aim is to show that while Plato is clearly aware that retaliatory anger has negative effects on people’s behavior, the strategy we find in his dialogues is not to eliminate anger altogether; instead, Plato aims to transform or rechannel destructive retaliatory anger into a different, more productive, reformative anger. I argue that this new form of anger plays a crucial positive role (...) in our intellectual and moral development. In relation to our intellectual development, anger is often part of people’s reactions to the Socratic interrogations and it often helps or hinders attempts to acknowledge one’s ignorance and become motivated to learn. For anger to play a positive role in the context of philosophical conversations, Plato suggests its transformation from being an outward-looking and reactive emotion oriented towards retaliation (refutation), into a mostly inward-looking emotion aimed at ones’ own moral and intellectual reform or self-betterment. In relation to our moral progress, anger is strategically linked both to the control of our appetites and to the virtue of courage, so anger is crucial to the psychology of the good citizen. Concretely, anger is needed both for the development of the right opposition to injustice and greed, and for the formation of an adequate sensitivity to justice. (shrink)

This article analyses the epistemic status of law and its presumption of being a science in relation with the so-called demarcation criterion proposed by different philosophers of science. Such criteria are the main analytical elements to differentiate scientific discourses from those who are not and the ones who pretend to be. In relation to those, pseudoscience and law are treated, to finally conclude with the exposition of the case of Daubert v. Merrill Dow Pharmaceuticals, in which a judicial process defined (...) demarcation criteria. This paper shows how the demarcation criteria of science and the concept of pseudoscience cannot be applied to law science given its own rationality. (shrink)

Este trabajo analiza los patrones de desambiguación de presuposiciones que se pueden considerar anafóricas y son generadas por partículas indexicales. En contraste con teorías recientes sobre la presuposición que privilegian la información lexical proponemos un análisis perspectivo de la presuposición según el cual la inferencia por defecto sobre este tipo de información hace uso de la perspectiva de los hablantes. En dos estudios exploramos el patrón de desambiguación de oraciones que contienen la palabra ‘también’ en contextos donde se usa el (...) indéxico ‘yo’. Los resultados confirman nuestra hipótesis y se discuten a la luz las principales ideas sobre presuposición y anáfora. A partir de estos resultados sugerimos algunas direcciones futuras de investigación. (shrink)

The Food and Drug Administration (FDA) recently issued its first approval of an oral contraceptive medication for access without a clinician’s prescription. One might expect this will lead to fewer people seeking to terminate unplanned pregnancies, including in states that imposed severe restrictions on abortion care following the Supreme Court’s reversal on abortion rights in Dobbs v. Jackson Women’s Health Organization. Despite the clear potential health benefits, increased accessibility of oral contraceptives offers no real solution to ongoing threats to patients’ (...) reproductive health and moral rights created by post-Dobbs abortion restrictions. To secure their patients’ reproductive health and well-being, clinicians must work to maximize the benefits of OTC oral contraceptives without relenting in their advocacy for safe and accessible abortion care. El presente artículo es un extracto de la Tesis Doctoral leída en la Facultad de Filosofía de la Universidad de Oviedo el 16 de abril de 2010 titulada Educación para la Libertad en el pensamiento de John Stuart Mill. Este artículo recoge de forma resumida, a lo largo de sus páginas, los aspectos más destacables de dicha Tesis Doctoral. Se subraya el aspecto de la educación como elemento fundamental en el pensamiento del filósofo inglés John Stuart Mill, en el sentido (...) de mostrar la educación como aquello que permite sacar al exterior las capacidades, talentos, destrezas que la persona posee. Al mismo tiempo es la educación, en el marco de la cultura, la que afina y refina a la persona, ayudándola a construirse como una persona que se incorpore a la ciudadanía con derechos y deberes y que ejerza esa ciudadanía responsablemente en aras del bien común. La educación hace al ser humano más libre, y la libertad es la esencia de la persona en el pensamiento de Stuart Mill. (shrink)

El estudio actual de la argumentación se encuentra distanciado de la lógica. En este artículo sostengo que restaurar el vínculo del estudio de la argumentación con esta disciplina podría resultar benéfico para la metas descriptivas y normativas de este campo de investigación. Tras destacar algunos aspectos del surgimiento la teoría de la argumentación contemporánea, enfatizando la idea de "perspectivas", explico cómo el reconocimiento de sus objetivos y tareas volvió problemática la coexistencia de varios enfoques o aproximaciones para el estudio de (...) la realidad argumentativa. Sugiero algunas hipótesis explicativas sobre el abandono del enfoque lógico en favor de otras alternativas y, a continuación, ofrezco razones para encauzar el estudio sistemático de la argumentación desde este enfoque. Además de las consideraciones normativas y las herramientas descriptivas que pueden aducirse en su favor, sostengo que el enfoque lógico puede proporcionar una clase de integración a este campo investigación de maneras que no están disponibles para otras aproximaciones. Frente a problemas de decisión colectiva de cierta complejidad, distintos métodos de votación pueden considerarse igualmente democráticos. Ante esta situación, argumento que es posible investigar cuáles de esos métodos producen mejores resultados epistémicos sobre asuntos fácticos. Comienzo ilustrando la relación entre democracia y métodos de votación con un sencillo ejemplo. Muestro cómo el uso de modelos idealizados permite descubrir algunas propiedades de los métodos de votación; varios de estos descubrimientos muestran que, frente a problemas de cierta complejidad, no hay una (...) respuesta clara acerca de cuál es el resultado de una elección democrática. Frente a esto, sugiero que deberíamos tomar en cuenta un rasgo epistémico instrumental de varios métodos de votación: su capacidad para generar respuestas correctas ante varias situaciones. Esta intuición ofrece lecciones importantes para el diseño de instituciones electorales. (shrink)

En décadas recientes se ha considerado que una formulación adecuada del autoconocimiento (AC) debería ser consistente con la tesis del externalismo (E). Michael McKinsey es uno de los personajes que ha enfatizado con mayor ahínco que la conjunción de ambas posturas es inconsistente. En este trabajo defiendo la idea de que las objeciones presentadas por McKinsey no afectan de manera importante la formulación davidsoniana de la autoridad de la primera persona (AC3) en conjunción con (E); señalo, además, que si no (...) pudiera hacerse una reconstrucción à la Davidson de (AC3) desde la postura de McKinsey sería en virtud de las diferencias metodológicas, semánticas, epistemológicas y ontológicas entre ambos autores, y no debido a que esta reconstrucción en sí misma sea incompatible con el externalismo. El artículo de investigación rememora en 2019 el 150 aniversario de la publicación de John Stuart Mill titulada La Esclavitud Femenina (1869). Recorre los principales ejes temáticos del autor acerca de su idea de mujer, de la necesidad de liberar a la mujer e igualarla al varón en los terrenos de la familia, laboral, educativo y político.

En el presente artículo, el autor se ocupa de esbozar una caracterización general del autoengaño desde algunas de las principales perspectivas en la materia, señalando los problemas centrales que involucra y haciendo énfasis en la línea intencionalista. Luego analiza la relación que el autoengaño guarda con la autoridad de la primera persona y qué imagen resulta de una conjunción teórica de ambos problemas.

The paper reviews the foundational ideals that gave “Europe”, an integration project with continental ambitions, its initial meaning or identity. “Europe” meant reconciliation and peace, reconstruction and widespread prosperity, and the mitigation of nationalism through the creation of supranational communities. A broad cultural consensus made it easier to trust each other and work together. The enterprise received a tacit approval from Europeans throughout the initial stages. More than 60 years and 20 member states later the project is under strain in (...) the social, economic, political and cultural fields. Today, as Europeans (now continental citizens) experience not only the advantages, but also the sacrifices of belonging to “Europe” (in the form of a Union), their allegiance to, and indeed the identity of the whole project are in question. I will submit that the original identity of “Europe” should be revived, and revisited for it to evolve in response to the present challenges. If its future identity is that of an intercultural, inclusive, flexible, and analogical polity, Europe will be still worth fighting for. (shrink)

El presente artículo trata, desde una perspectiva histórica, mostrar el debate entre la Razón y la Fe en la Historia de la Filosofía.

From the political point of view, European Union (EU) integration implies some kind of unity in the community constituted by EU citizens. Unity is difficult to attain if the diversity of citizens (and their nations) is to be respected. A thick bond that melts members' diversity into a 'European pot' is therefore out of the question. On the other hand, giving up unity altogether makes political integration impossible. Through a meta-theoretical analysis of normative positions, this paper proposes a composed notion (...) of European identity that links without binding. It contains four facets – cultural, political, social, external – with nuances, expressed in three binaries, that cut across all of them – history-project, ethos-achievement, commonness-uncommonness. I will submit that a workable European identity (and the related concepts of unity, polity and citizenship) can be better conceived as analogical – a mid way between blending unity and irreconcilable diversity. Eyal et al have recently argued that researchers should consider conducting severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) human challenge studies to hasten vaccine development. We have conducted (J. L.) and overseen (L. D.) human challenge studies and agree that they can be useful in developing anti-infective agents. We also agree that adults can autonomously choose to undergo risks with no prospect of direct benefit to themselves. However, we disagree that SARS-CoV-2 challenge studies are ethically appropriate at this time, for (...) 3 reasons: (1) current scientific knowledge of SARS-CoV-2 infection is insufficient to manage risks; (2) autonomous decision making, while necessary, does not override concerns about risk; and (3) undertaking challenge studies now would imperil confidence in the research enterprise, potentially undermining the global response to the coronavirus disease 2019 (COVID-19) pandemic. The Lautsi case in Italy attracted widespread attention in Europe and beyond. Though the issue under contention was a Christian symbol, the European Court of Human Rights (ECHR) judgements showed changes in assessment both about religion (in contrast with former cases regarding Muslim veils) and secularism (which did not have the same meaning for everyone). In light of those rulings, this paper reflects on the concepts of neutrality and secularism and their normative implications for European citizens in terms of belonging, (...) solidarity and cohesion. An open and plural public sphere, in which intercultural exchange can flourish, is crucial if Europe is serious about the integration of its immigrants, many of whom possess a Muslim background. A ‘post-secular’ Europe may have to reconsider long-held stereotypes about religion and nuance its self-understanding as ‘secular’, in a way that religious citizens can identify with Europe too. The discussion will draw on the ideas of Taylor, Casanova, Habermas, Weiler and Beck to illustrate some of the political, ethical and theoretical complexities of the Lautsi case, specifically issues to do with neutrality, secularism and the role of religion in the public sphere. Este libro es un ensayo filosófico que expresa la relevancia que para John Stuart Mill tiene la educación, hasta el punto de considerarla como un derecho fundamental de las personas, teniendo en cuenta que en su tiempo no existían los hoy conocidos Derechos Humanos. Stuart Mill se adelanta a nuestra época y presenta a la educación como ese derecho básico de toda persona que ha de ser protegido, potenciado y proporcionado por los diversos Estados.
